FARMERS LEGAL ACTION GROUP LETTER TO THE CITY ATTORNEY, OUTLINING THE EVENTS.
Mr. Troy Gilchrist is beating about the bush, the Judge would not say that the Court is troubled by the seemingly broad definition of structure. That is the precious reason I included the definition, but if you Mr. Troy Gilchrist insist upon the ordinance number, that would be Section 15, Subdiv. 3. No resident in the history of the City of Watson has been prosecuted for violating this ordinance but myself. Mr. Alsop should stop misleading the people and the press by mincing words Below is an extract from the Summons and Complaint filed by the City of Watson against me.
Even though the above definition exempts fences, but my fence posts have been cited as structure and therefore must be removed, how can I erect a fence without putting fence posts. This entire law suite is based on either twisted thinking or twisted motives. When I applied for a permit for the fence, my check was returned after 4 months without any reason, since then the ordinance has been changed and the exemption does not include fence, meaning, now one needs a permit to put up a fence, but one did not require a permit when the City filed the complaint, according to all this I should be grandfathered for the fence. However, because a fence post is erected on the ground it becomes a structure therefore i need a permit. City Attorney make up your mind and stop charging huge fee for stupid reasons.
